UNFAIR COMMERCIAL PRACTICES

On September 24, 2015 entered into force the Decree-Law 205/2015, of 23 September, which amended the legal regime applicable to unfair commercial practices

 

See below the main amendments:

 

  • The legal framework is now applicable to unfair commercial practices between companies concerning false information or information that deceive or is likely to deceive in relation to one or more of the elements foreseen in the law.

 

  • Clarification of the unfair commercial practices concerning invitations to purchase products or services with the intention of promoting a different product.

 

  • Clarification of the situations that could be considered a pyramid promotional scheme.

 

The following amendments should also be highlighted:

  • The practice of rounding up prices, duration or any other factor was eliminated from the list of unfair commercial practices.

 

  • The provision regarding the supply of goods and services without being ordered by the consumer was also removed.
