A.M.Moura & Associados - Sociedade de Advogados, SP, RL (AMM), respects your privacy and your rights as a holder of personal data, acting under the provisions of the General Data Protection Regulation (GDPR).

This Privacy Policy describes who we are, for what purposes we can use your data, how we treat it, with whom we share it, for how long we keep it, as well as how to contact us and exercise your rights.

AMM is responsible for the processing of personal data within the meaning of the GDPR.

AMM will only process your personal data:

a) to fulfil a contract, such as contracts for the provision of legal services, or contracts with our suppliers;

b) In pursuit of legitimate interest, namely for

  • Development and maintenance of our website,
  • Provision of technical assistance;
  • Fraud prevention and detection;
  • Ensure network and information security;
  • Provision of services or information.

c) With your consent to process your personal data for specific, explicit and legitimate purposes; and/or

d) If necessary to fulfil legal obligations that apply to it.

3. Purpose of processing your information

If you register for one of our events, some of your personal data may be shared with entities organizing the said event and/or with other participants.

If you consent, you will receive marketing communications via email. You may, at any time object to this data processing.

Your consent is essential for AMM to process your personal data for specific purposes; however, if you choose not to give your consent, your visit and use of our website will not be affected.

4. Term during which we keep your information

a) Request access to the information we keep about you

As a holder of personal data, you have the right to obtain confirmation that the data concerning you are or are not subject to treatment and, if applicable, to access your personal data and access the information provided by Law.

b) Request the rectification of information if it is inaccurate or incomplete

As the holder of personal data, you have the right to have AMM, without undue delay, rectify inaccurate or incomplete data concerning you.

c) Request the deletion of your personal data

As a holder of personal data, you have the right to request AMM to erase your data without undue delay, and it has an obligation to erase personal data without undue delay, when one of the following reasons applies, namely

(i) Personal data are no longer necessary for the purpose that motivated their collection or processing;

(ii) Withdrew your consent to the processing of data (in cases where the processing is based on consent) and there is no other basis for said processing;

(iii) Opposes treatment, and there are no prevailing legitimate interests to justify treatment.

d) Request to limit the processing of your personal data

As a data subject, you have the right to request AMM to restrict the processing of your data if, in particular, one of the following situations applies:

(i) Challenge the accuracy of personal data, for a period that allows AMM to verify its accuracy;

(ii) The processing of data is lawful, and the data subject opposes the deletion of personal data and requests, in return, to limit its use;

(iii) AMM no longer needs personal data for processing purposes, but the holder requires such data for declaring, exercising or defending a right in a judicial process;

(iv) If you have opposed the processing until it is found that the legitimate motives of the controller override those of the data subject.

e) Oppose the processing of your personal data

(i) In cases where data processing is carried out for the legitimate interests pursued by AMM; or

(ii) the processing of data is carried out for direct marketing or (iii) definition of profiles, you can also, at any time, object to the processing of your personal data.

f) If the treatment depends on your consent, you have the right to withdraw it.

If consent is legally necessary for the processing of personal data, the data subject has the right to withdraw consent at any time, although this right does not compromise the lawfulness of the treatment carried out on the basis of the previously given consent or the further processing of the same data, based on another legal basis, such as compliance with the contract or legal obligation to which AMM is subject.

Your requests will be treated with special care so that we can ensure the effectiveness of your rights. You may be asked to prove your identity to ensure that personal data is shared only with the holder.

You should keep in mind that your request cannot be satisfied immediately in some instances (for example, due to legal requirements).

In any case, you will be informed of the measures taken in this direction, within one month from the moment the order is placed.

You also have the right to file a complaint with the National Data Protection Commission.

6. Security and Confidentiality

AMM strives to keep your data safe, using the appropriate security measures to protect your personal data and prevent access to unauthorized persons. We subject our security systems and policies to periodic reviews to ensure that the data is safe and protected. However, the transmission of information over the Internet is not entirely secure, and we cannot guarantee the security of the information transmitted through our website.

We also respect the confidentiality of your information. As such, we do not sell, distribute or otherwise make your information commercially available to any third party. AMM is committed to keeping your information confidential under this Privacy Policy and applicable legislation.
