SELECTIVE BLOCKING OF COMMUNICATIONS RELATED TO VALUE-ADDED SERVICES

The Law No. 42/2013 published in Official Gazette on July 3, 2013, carried-out the eighth amendment to Law No. 5/2004, February 10 (Electronic Communications Law) and introduce the new rules regarding  selective communications blocking of value added services based on message sending, including SMS (short message service) and MMS (multimedia messaging service), and audio text service. 

Accordingly to the new rules the services providers must ensure the SMS barring regarding : (i) services which involve the sending of more than one message or the sending of periodically or continued messages and (ii) services that have sexual or erotic content. 

Regarding to any other value-added services the new rules foreseen that the services providers must ensure the free charge barring within 24 hours upon their clients request. 

Up to 17 August 2013 the service providers must also provide written information to their clients about the new rules of barring value-added services as well as informed them about the need of request the barring the value-added services that will start to be provided without the previous request from the Clients.
