DIRECT MARKETING: NEW CNPD GUIDELINES

Guideline No. 2022/1

 

Considering several breaches of the applicable legislation and multiple claims submitted in recent years to the Portuguese data protection authority (known as CNPD), Guideline no. 2022/1 was recently published. It relates to electronic direct marketing communications aimed at individuals.   

The main recipients are data controllers and processors, and the Guideline does not apply to unsolicited electronic communications for direct marketing purposes aimed at collective entities (which are admissible until the recipients refuse future communications and subscribe to the competent list provided by the DGC).

The Guideline addresses the context in which the processing of personal data for direct marketing purposes may occur, the respective legal grounds and the conditions of regularity of conduct of all the parties concerned, including data brokers.

The CNPD also clarifies the obligations that companies must comply with, such as appropriate technical and organizational measures and updated lists with relevant information.

Therefore, changes in companies may be necessary to adjust the compliance of documents and procedures related to direct marketing and data protection.
