PUBLIC LAW – NEW EU DIRECTIVES

European Parliament and the European Council recently approved new European legislation in order to review the rules currently applicable to public procedures for the award of concession contracts (Directive 2014/CE/UE); of public works contracts, leasing, acquisition of goods and services (Directive 2014/24/UE) contracts; and public contracts by entities operating in the water, energy, transport and postal services sectors (Directive/25/UE). 

We highlight the following aspects: 

  • a) Price changes (lower);
  • b) Social and environmental criteria;
  • c) Simplification of procedures.  

The review of the directives aim to ensure a better use of public funds and encourage growth, employment and social inclusion with the UE Members. 

The 2014/23/UE Directive will only apply to the award of concession tendered or awarded after April 17, 2014. 

Finally, the Directives 2014/24/UE and 2015/25/UE repeal Directive 2004/18/EC and Directive 2004/17/EC with effect from April 18, 2016. The Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directives until April 18, 2016.
