ALTERNATIVE DISPUTE RESOLUTION FOR CONSUMER DISPUTES

The adjustment period granted to the suppliers of goods and service providers subject to Law number 144/2015, of 8 September, that establish the new rules for alternative resolution of consumer disputes, ended on 23 March 2016.

The suppliers of goods and service providers established in Portugal should now inform the consumers about the Alternative Dispute Resolution entities available or by which those traders are covered, including the website of the relevant entity.

The mandatory information should be included in the website of the suppliers of goods and service providers, as well as in contracts concluded with consumers.

Failure to comply with the new obligation is subject to a fine between 500 EUR and 5,000 EUR, in the case of individuals, and between 5,000 EUR and 25,000 EUR in the case of legal persons.
